What Device Migration Lawsuits Are There

Can You Get Pregnant After Mirena IUD | 6 Years LATER

Miriam Cruz filed her Mirena lawsuit when the device she had implanted in 2008 caused her severe pain years after implementation. Bayer claimed that the only way Mirena would migrate would be if the doctor made a mistake during placement. However, since Cruz did not suffer until several years after placement, it is evident that the device did in fact migrate. In her Mirena lawsuit, Cruz claimed that the company did not properly inform her of such risks and that the product was not properly represented when she chose to use it.

Melody Williams filed a Mirena lawsuit claiming that Bayer Pharmaceuticals was guilty of fraud, negligent misrepresentation, and failure to warn patients of dangerous side effects. Williams started experiencing severe abdominal pain and cramping within a year of her implantation. Her device was found to have migrated through her right fallopian tube and required surgery to have it removed.

The Problem With Mirena Iuds Operation

The device itself is small and in the shape of a T. Made from a flexible plastic, Mirena releases a hormone known as levonorgesterel. This hormone is no stranger in oral contraceptives, but with Mirena it gets released continuously for years. Levonorgesterel thickens the uterus mucous lining which in turn makes it harder for sperm to survive. This is how Mirena reduces the chance of pregnancy.

However, the odd thing about this particular form of birth control is that even its maker, Bayer, admits its not entirely sure how the device works.

What Are Some Common Contraceptive Lawsuit Claims

The Chanceys in the 505: My Mirena Story (A Cautionary Tale)

There are a number of serious injuries that a consumer may suffer after using a contraceptive. For instance, the consumer may become infertile, experience blood clots, give birth to a child with birth defects, and/or even cause the consumer to become deceased. While contraceptives rarely ever cause their users to die, death is still a possibility and any other injuries associated with the use of contraceptives tend to be fairly serious.

Some additional injuries that a plaintiff may suffer from using a contraceptive may include:

  • Pains near or in the pelvic area
  • Formations of ovarian cysts
  • Swelling or ulcers in bodily organs
  • Stroke deep vein thrombosis
  • Mood swings, depression, and other mental or emotional side effects caused by the hormones used to make a specific type of contraceptive
  • Emotional or mental anguish associated with an unwanted pregnancy or childbirth and/or
  • Complications from undergoing multiple surgeries to remove or locate the IUD or another type of contraceptive implant.

One common claim that may serve as the basis of a lawsuit involving injuries caused by a contraceptive is a claim for products liability, which may be filed against the manufacturer of the contraceptive in question.

In general, a product liability lawsuit may be filed when a consumer is injured by a product due to a defect found in the product. For example, a contraceptive may have a defect in its design or with its warning label if the label is missing or insufficient.

Woman Files Medical Malpractice Lawsuit Against Ob/gyn

There are many different forms of birth control that are out on the market, including intrauterine devices, known commonly as IUDs. Over the years, one device that has gained popularity is the Mirena IUD. And, even though there have been a number of women who have complained about pain with this IUD, the Federal Drug Administration did approve the device in 2000.

However, in a recent case, a woman who had the IUD implanted is not suing the maker of Mirena. Rather, she filed a lawsuit against a doctor and the gynecological and obstetrics clinic the doctor works at.

When looking at what happened, it was back in 2006 when the woman had an IUD implanted. However, despite the presence of the IUD, the woman found out in 2007 that she had developed a left ectopic pregnancy. As a result of the unexpected pregnancy, her doctor had to perform several procedures.

At that time, the doctor was unable to find the IUD. However, the doctor did not use an imaging device to attempt to find the missing IUD even though there was a high likelihood that it was left inside the patients body.

In fact, despite continued complaints about pain, the doctor at this particular clinic did not take any steps that would have identified where the missing IUD was located. Instead, the patient was told she was probably just ovulating and to take some ibuprofen for the pain.

Paragard And Ectopic Pregnancy Risk

Paragard IUD has also been shown to increase the risk of an ectopic pregnancy, which is a pregnancy that starts off in another location outside of the uterus. This can be potentially life-threatening as an ectopic pregnancy can cause severe health complications to both the mother and the baby, cause uncontrolled bleeding and lead to death.

A Broken Paragard Iud Can Cause Severe Complications

Patients are told that the device can be removed from their uterus at any time. Still, they may not be aware that the removal process is not nearly as easy as the manufacturers of Paragard imply. The device has the potential to break, presenting a new set of threats to ones health and further difficulty with device removal.

The Paragard IUDs design is meant to minimize pain and discomfort, and part of that device includes smooth, rounded edges on each end of its T-shaped frame.

Wen an arm on the Paragard IUD breaks, the result may be:

  • The creation of one or more jagged pieces of the device being lodged in the uterus
  • The sharp edge of the broken piece piercing the uterine wall
  • The broken piece needing to be removed with surgery to prevent further damage

The U.S. Food and Drug Administration published findings regarding the possibilities of IUDs breaking apart in the body. Paragard IUDs feature a copper coil spiraling on the vertical portion of the devices T-shaped frame. In 2016, a patient needed the device surgically removed after it broke apart inside the uterus. This may also pose an additional risk factor for patients looking to have this form of contraception removed.

Patients Report Debilitating Mirena Side Effects

I Got Pregnant With An IUD

Each Mirena lawsuit cites complications from the IUD including:

  • IUD expulsion. Reported in around 6% of users, expulsion may go unnoticed, leaving the woman open to unwanted pregnancy. The risk of expulsion is greater in women who have never given birth.
  • Ectopic pregnancy. Sometimes referred to as a tubal pregnancy, ectopic pregnancies occur when the egg becomes fertilized outside of the uterus. It is a life-threatening condition, and usually requires surgery to remove the zygote , a procedure that can result in infertility.
  • Pelvic inflammatory disease. When the Mirena IUD migrates out of position, it may cause a bacterial infection, resulting in pelvic inflammatory disease . Women with a history of PID should avoid using Mirena, or any other IUD.
  • Device migration. This can lead to perforation of the uterus and requires corrective surgery.

The most dangerous side effect uterine perforation can result in chronic infections, internal adhesions and organ damage. Multiple surgeries may be required to correct the condition and fully remove all remnants of the device. The risk is greater in women who are implanted with the IUD immediately after giving birth. Bayer claims that uterine perforation is a rare occurrence, but a study published by the Department of Radiology at the Ronald Reagan UCLA Medical Center has concluded that it is a frequently encountered complication.

What Fda Warnings Are There Regarding Mirena

Since 2004, the FDA has received over 47 thousand reports of adverse events related to Mirena use. In 2009, the FDA issued a warning to its manufacturer, Bayer for overstating the effectiveness of the device and minimizing risks. Bayer had claimed in its Simple Style live marketing talks targeting busy moms that the IUD would help women with increased libido and that they would look and feel great.

As shared in the warning letter, at least 5 percent of women using the Mirena IUD are reporting decreased libido during clinical trials. The Division of Drug Marketing, Advertising, and Communications , a department of the FDA that reviews marketing plans and documents of pharmaceuticals had concluded that this program overstated Mirenas benefits while downplaying side effects.

Bayer has also been warned by the FDA regarding advertising for some of its other birth control products including Yasmin and Yaz oral contraceptives.

What Are The Odds Of Pregnancy After Vasectomy

There arent any standard odds of getting pregnant after vasectomy. A 2004 survey suggests that theres about 1 pregnancy per every 1,000 vasectomies. That makes vasectomies about 99.9 percent effective for preventing pregnancy.

Keep in mind that vasectomies dont offer immediate protection against pregnancy. Sperm are stored in the vas deferens and will remain there for a few weeks or months after the procedure.

This is why doctors recommend that people use an alternative method of contraception for at least three months after the procedure. Its estimated that about are required to clear out all the sperm. Learn more about having sex after vasectomy.

Doctors also usually have people whove had a vasectomy come in for semen analysis three months after the procedure. Theyll take a sample and analyze it for any live sperm. Until this appointment, its best to use a backup birth control method, such as condoms or the pill, to prevent pregnancy.

Paragard Side Effects & Complications

At this time, the most notable Paragard side effects occur when the devices arms break off inside of the body. The broken plastic and copper coil can get embedded in the uterine wall or other organs.

Those affected may need to undergo invasive surgeries, such as a hysteroscopy or hysterectomy, to have the fragments removed from the body. While doctors may be able to remove the fragments with these surgeries, they could have lasting consequences for example, if a patient must undergo a hysterectomy, she can never become pregnant.

Further, some Paragard IUD removal surgeries can even fail to remove the fragments. A Paragard lawsuit filed in March 2020 noted that the plaintiff still had a piece of the IUD embedded in her uterine lining despite several attempts to remove it.

Desire To Continue The Pregnancy

Complications and Symptoms of a Mirena IUD

If the woman wishes to continue with the pregnancy, a doctor will perform a pelvic examination. If the IUD strings are visible, the doctor will remove the IUD gently.

If the IUD strings are not visible, a woman may need to undergo an ultrasound to determine its location. The next course of action depends on the location, as below:

  • No IUD found: The woman will need an X-ray to locate the device.
  • IUD within the cervix: The doctor will remove the IUD by pulling the strings.
  • IUD above the cervix: The doctor will talk about the risks and complications of continuing the pregnancy.

How Does It Happen

In a small number of people between 2 and 10 percent the IUD can slip partly or completely out of the uterus.

If this happens, you can get pregnant. You might not realize the IUD has fallen out of place.

In some cases, pregnancy can happen because the IUD hasnt started to work.

The copper IUD, Paragard, protects against pregnancy immediately.

But hormonal IUDs, such as Mirena and Skyla, can take up to seven days to become effective. You could get pregnant if you have sex without a condom or other form of protection during this window.

You may also experience IUD failure if the IUD has been in place for longer than the manufacturer recommends.

Although one 2015 study found that Mirena may protect against pregnancy for a full year after its FDA-approved expiration date, more research is needed to confirm this finding.

What Is A Miscarriage

A miscarriage happens if a pregnancy ends spontaneously before its 20th week. At that point, the fetus isnt developed enough to survive outside the uterus.

If you get pregnant while using an IUD, the device increases the risk of miscarriage. If you want to stay pregnant, its important to remove the IUD early in pregnancy.

Sometimes, an IUD can slip out of place. If that happens, the risk of pregnancy is higher.

To check the placement of your IUD:

  • Wash your hands with soap and water.
  • Get into a comfortable sitting or squatting position.
  • Insert your index or middle finger into your vagina. You should be able to feel the string attached to your IUD, but not the hard plastic of the IUD itself.
  • Contact your doctor if:

    • you cant feel the IUD string
    • the IUD string feels longer or shorter than it used to
    • you can feel the hard plastic of the IUD coming out of your cervix

Your doctor can use an ultrasound exam to check the internal positioning of your IUD. If it has slipped out of place, they can insert a new IUD.

What Happens If Your Iud Has Moved

To determine whether your IUD has moved, your doctor or healthcare provider will first use a small brush to try to find the strings inside your cervix. If they can find the strings, its unlikely your IUD has moved.

If they cant find the string, theyll do a pregnancy test. Pregnancy with an IUD can be dangerous. If necessary, your doctor can give you emergency contraceptives and a backup method of birth control.

Next, theyll do an ultrasound to look for your IUD within your uterus. If the IUD is still in your uterus, its up to you and your doctor whether you should take it out or leave it in. This depends on your:

    • symptoms
    • personal preference
    • exact location of the IUD

If you got the IUD recently, it may move into place on its own after a few months.

If your IUD cant be found using ultrasound, your doctor will do an X-ray of your abdomen and pelvis. If they find your IUD, they can remove the IUD through a laparoscopic procedure.

If you want, the IUD can be replaced immediately. If your doctor cant find your IUD using X-ray, they may conclude that your IUD was expelled . If your IUD was expelled, you and your doctor should talk about other options for birth control.

Your doctor may also be able to see your IUD in your cervix before doing an ultrasound or X-ray. If they do, this means the IUD was partially expelled and will need to be removed.

There are many birth control options to choose from. An IUD has many benefits, but it may not be the right choice for you.
