Although Pregnancy Doesn’t Qualify As A Disability Under The Americans With Disabilities Act Pregnant Employees Have The Right To Be Treated Just As Their Employer Treats Other Employees Who Are Temporarily Unable To Work

Pregnancy doesn’t qualify as a disability under the Americans with Disabilities Act , the federal law that prohibits workplace disability discrimination. However, pregnancy discrimination is illegal in its own right. Employers may not make job decisions based on an employee’s pregnancy, and must treat employees who are temporarily unable to work due to pregnancy just as they treat employees who are temporarily disabled for other reasons. Pregnant employees may also be entitled to time off work under the Family and Medical Leave Act and state leave laws.

Short Term Disability Maternity

Early in your planning process, talk to HR to find out all the details of your parental leave. What options do you have? Confirm that short-term disability benefits consider pregnancy a pre-existing condition where you work.

Ask specifically if short-term disability covers parental leave. Getting answers to these questions is an important first step in planning your options.

Discuss with your partner what you can afford, then discuss what you know with your employer. Again, it is important to do this in advance. The more time you have, the more relaxed you will feel about your upcoming discharge and postpartum experience.

Find out your companyâs policy on parental leave. Some companies are more understanding than others, and this can affect when you decide to share your news with them, as well as your future employment plans.

Remember that you want to discuss short-term disability before you get pregnant, not after you give birth. The sooner you can reasonably start planning, the better.

How Other Benefits Affect Your Sdi Benefit

Sick pay or PTO. Paid sick time, PTO, or holiday pay that you receive while receiving SDI will be subtracted from your SDI benefit amount, as will wages for part-time work . You can ask the EDD to “integrate” the SDI benefit with your sick pay or PTO, however. If your employer agrees, your employer can pay you just enough sick time or PTO so that, when combined with SDI, you will be receiving the same amount as your normal salary or wages. On your application form, you write “Integrated Benefits” for the type of pay you are receiving from your employer.

In addition, you may receive sick time or PTO for the first seven days of your disability, since SDI will only start paying you on the eighth day.

Paid vacation. Receiving paid vacation benefits will not affect your SDI payment.

Social Security disability. If you apply for and are approved for Social Security disability benefits, the state may subtract your disability benefits from your SDI payment.

How Do You File For Short

If you believe that youll need to take advantage of your short-term disability benefit, your first step is to make sure that your illness or injury is well-documented, as youll have to provide some medical evidence or backing.

Consult with your doctor and find out what youre up against first. Make sure you speak honestly about your symptoms and the things that you are experiencing. That medical record will be reviewed by an insurance company, so start out with a strong pronouncement of, Hey, Im having this problem, advises McDonald.

Then, approach your HR department to begin the process of filing a claim . Dont have an HR department? Connect with your manager or consult your plan documents to understand exactly what you need to do to submit your claim.

Be aware that short-term disability plans have a requirement for how many days you need to be out of work before you can claim disabilityits called an elimination period. The reason is that they dont want to invoke short-term disability for something that could be covered by sick days, says Bartolic.

Long Term Disability Coverage Can Provide Further Protection

If you have long term disability insurance that you purchased through the workplace or as an individual from an insurance company, it typically wont cover a typical pregnancy and recovery, due to the longer elimination period required under an LTD plan. However as with STD coverage complications are another matter, and if an issue renders you unable to work, it will generally be covered if the disability satisfies the benefit waiting period for the LTD. Also, pregnancy can worsen other conditions that may have been dormant or under control, such as diabetes or multiple sclerosis. Post-partum depression can be issue for people who have never experienced mental health issues, and if it causes you to miss work it could be covered by your LTD policy.

One thing to remember about LTD coverage: compared to short term disability, theres typically a much longer waiting or elimination period until benefit payments start. The typical STD plan has a 2-week waiting period with an LTD plan, the elimination period commonly lasts 60-90 days, but it can be as long as a year.

Can You Be Fired While On Maternity Leave Or Sick Leave

Note: This section is focused on non-unionized workplaces. Unionized workplaces will often have basic protections against being fired while taking maternity or sick leave, and may go even further to protect the employee. If you are part of a union, you will need to consult the unions collective agreement this is where the rules for your approved leaves can be found.

People on sick leave and maternity leave have protections under the human rights act and employment standards laws of their province.

Employment standards acts set out the rules for all types of approved leaves including sick leave and maternity leave. They give people a right to take a period of maternity or parental leave and set out how long the leave can be. They often include a right of reinstatement for an employee on an approved leave.

Ontarios Employment Standards Act, for example, includes:

Section 53: Reinstatement

53 Upon the conclusion of an employees leave under this Part, the employer shall reinstate the employee to the position the employee most recently held with the employer, if it still exists, or to a comparable position, if it does not.

How Much Does Short Term Disability Insurance Cost

The cost of short term disability insurance is determined by the underwriting process. The underwriting for short term disability insurance may differ slightly from long term disability policies.

Individual long term disability insurance requires full underwriting. Insurers have to assess a personâs risk of filing a claim because benefits may be paid out for a long period. Therefore, insurers will assess your application based on your age, health, gender, the level of risk associated with your job, and any hobbies or interests that could cause disability.

On the other hand, disability insurance carriers may not fully underwrite short term policies. As stated earlier, many short term policies sold on an individual basis are guaranteed issue, which means no underwriting. Others may only require the answering of questions about your health without the medical exam required for long term disability insurance.

Injuries that cause temporary disabilities generally are not related to the insuredâs age, health, job, or other risk factors. They just happen, be it a bad fall that causes a broken bone or a complication of pregnancy. Still, you may be asked about pre-existing health conditions that disqualify you from coverage or that will limit your benefits.

States With Paid Family Leave Laws

Recognizing the importance of parental leave, more and more states are enacting PFL laws that go a step beyond FMLA by providing paid leave for employees who need to take off. Those states are:

  • California
  • Washington
  • The District of Columbia

Each state sets its own rules about which employees and situations qualify for paid leave, how long paid leave lasts, how contributions to the paid leave fund are made, and the benefit amount. If you live in one of those states, go to the state government website and search for Paid Family Leave to find out the specific rules and benefits for where you live.

Disability Insurance And Maternity Leave

Can You Go To Doctor Pregnant While Waiting For Medicaid

When you get pregnant, you may decide to take maternity leave. This is a good way to stay home and prepare for your upcoming due date. Nevertheless, maternity leave comes with some drawbacks. If youre going to take maternity leave, you will not be able to use your disability policy. Remember that anything considered elective will not be covered under a disability insurance policy. This includes maternity leave. However, you are going to receive protection if you experience complications during or after pregnancy.

Furthermore, your doctor may recommend bed rest. Or, you may have a difficult birth. If this is the case, you might be able to qualify for benefits once the elimination period has elapsed. With some short-term disability group plans, the employer might list pregnancy as a disability instead of adding a maternity leave policy. To be positive, you should check your policy carefully.

Can You Use Short

The two short answers here are: Yes, under FMLA. And yes, if youve got the right insurance policy.

What Does Short Term Disability Insurance Cover

Short term disability insurance covers temporary injuries and illnesses that are less serious in nature. Like long term coverage, what qualifies for short term disability depends on the definition of disability, which varies from policy to policy. In general, eligibility for benefits is tied to your ability to perform the duties of your current occupation.

Your short term disability insurance policy may also require that you lose a certain percentage of earnings due to disability. During your short term disability leave, you may be required to provide the insurance company with updated medical information to verify your disability and continued eligibility for benefits beyond the initial approval of your claim.

In addition to injuries and illnesses that limit your ability to work, surgical procedures that are deemed medically necessary will qualify you for short term disability benefits. Some policies will provide benefits for bariatric weight-loss surgeries. Organ donation is usually covered as well. Purely cosmetic procedures will likely not be covered.

You may also qualify for benefits if prescription medications or medical procedures cause side effects that keep you from working.

How Often Will You Receive Payments

This is another area that can vary. Fortunately, your payment questions should be answered clearly within your plan documents.

Be aware that if your employer works with an insurer to offer short-term disability benefits, then payments will usually be administered through the insurance company. That means they might arrive on a schedule different from the payroll timing youre used to .

Meaghan Tiernan, a senior copywriter for a marketing agency in San Francisco, used her short-term disability for maternity leave. She was given a debit card that her short-term disability payments were added to.

I think it was one lump sum every two weeks on an regular basis, she explains. They even include weekends, so it was typically every 14 days that I was paid. Then youd have to transfer the funds from that debit card to your bank account if that was your preference.
